Terms of service

Rules for using the website and for providing services under the START, PLUS and PRO plans.

DRAFT DOCUMENT. This is a proposed structure for the terms of service, not a finished legal document. Before sales start and before payments are enabled it must be reviewed and completed by a lawyer, and the owner must confirm the processes described here.

1. General provisions and service provider details

These terms set out the rules for using the Blueward Digital website and for providing marketing services under subscription plans.

2. Definitions

For the purposes of these terms the following meanings apply:

  • Website — the Blueward Digital website together with the contact form and the AI assistant.
  • Client — a business or a consumer who enters into a service contract with the Service Provider.
  • Plan — a set of services with a defined scope and price: START, PLUS or PRO.
  • Billing period — a calendar month or another period indicated in the contract.
  • Advertising budget — funds spent on serving ads, paid by the Client directly to the advertising platform, outside the subscription.

3. Scope of services

The Service Provider delivers digital marketing services whose scope depends on the selected plan: designing and maintaining a website, SEO and GEO/AIO work, implementing an AI assistant, configuring analytics and running Google Ads and Meta Ads campaigns.

The detailed scope of each plan is described in the pricing section of the Website and in the offer presented to the Client before the contract is concluded. In the event of any discrepancy, the contract prevails.

The Service Provider does not guarantee specific search result positions or specific sales results — these depend on factors beyond the Service Provider's control, including platform algorithms, competition and the advertising budget.

4. Plans, prices and billing periods

Plan prices with a 12-month contract are: START — 199 PLN per month, PLUS — 399 PLN per month, PRO — 999 PLN per month. Prices for the flexible variant and the amount of the setup fee are shown in the pricing section of the Website.

Plan prices are the amounts payable — the Service Provider does not add VAT to them.

The advertising budget is not included in the subscription. The Client pays it directly to the advertising platform.

5. Conclusion of the contract

The contact form, the conversation with the AI assistant and the information on the Website do not constitute an offer within the meaning of the Civil Code, but an invitation to conclude a contract.

The contract is concluded once the scope of work has been agreed and both parties have accepted the terms.

6. Payments and recurring charges

The subscription is paid in advance for each billing period, on the basis of an invoice issued by the Service Provider.

As at the publication date of this document the Website does not accept online payments: no payment gateway or recurring payment is enabled on it and settlements take place outside the Website.

7. Start and delivery time

The standard website implementation time is 5 to 20 business days, counted from the day the Client provides all materials and the access credentials needed to start work.

The deadline is extended by the time spent waiting for materials, approvals or access on the Client's side.

8. Client obligations

The Client undertakes in particular to:

  • provide the materials (texts, photos, logo, company details) and the access credentials needed to deliver the service,
  • ensure that the materials provided do not infringe third-party rights, including copyright and trademark rights,
  • provide feedback and approve stages of the work on time,
  • comply with the terms of the third-party platforms (including Google and Meta) used in the work carried out for the Client,
  • pay the fees on time.

9. Changing a plan, suspension and cancellation

The Client may upgrade to a higher plan during the contract — the change takes effect from the next billing period.

10. Complaints

A complaint can be submitted to echostudio697@gmail.com, describing the issue and the expected resolution.

Rights to materials provided by the Client remain with the Client. The Client grants the Service Provider a licence to use them to the extent necessary to deliver the service.

12. Liability

The Service Provider is liable for the proper performance of the services on the terms set out in law and in the contract.

The Service Provider is not liable for the operation of third-party platforms, including changes to their algorithms, rules or prices, nor for interruptions in the services of hosting and email providers.

13. Termination

14. Consumers and the right of withdrawal

A consumer, and a sole trader for whom the contract is not of a professional nature, has the right to withdraw from a distance contract within 14 days without giving a reason.

If, at the express request of such a person, the service is to begin before the withdrawal period expires, that person is obliged to pay for the services performed up to the moment of withdrawal. The right of withdrawal expires once the service has been fully performed with the express and prior consent of that person and after they have acknowledged that they will lose that right.

15. Changes to these terms

16. Governing law and dispute resolution

Contracts concluded on the basis of these terms are governed by Polish law. The choice of law does not deprive a consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence.

A consumer may use out-of-court complaint and redress mechanisms, including the assistance of the district (municipal) consumer ombudsman and mediation at the regional inspectorates of the Trade Inspection.
